BERKELEY COLLEGE FOUNDATION 50-50 RAFFLE OFFICIAL RULES

 

TO ENTER

Purchase a ticket between March 1, 2020 at 9:00 AM (EST) and June 25, 2020 at 5:00 PM (EST) the “Raffle Period”. Each ticket is $20.00. Sponsor is not responsible for any lost, late, misdirected, incomplete, illegible, or destroyed tickets, regardless of cause. Cost of raffle ticket is not tax deductible as a charitable contribution.

 

SPONSOR

The sponsor (“Sponsor”) of this Raffle is Berkeley College Foundation, Inc., a 501(c)(3) organization located at 64 East Midland Avenue, Suite 7, Paramus, NJ 07652 (NJLGCCC No.: 373-5-41880, License No.: 1168). Direct all questions, comments or complaints regarding the Raffle to Sponsor.

 

ELIGIBILITY

This 50-50 Raffle (the “Raffle”) is open to legal residents of one of the 50 states or the District of Columbia who are at least 18 years of age or older at the time of entry, (“Entrants”). By entering this Raffle, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor shall be binding and final in all respects relating to this Raffle. Winning the prize is contingent upon fulfilling all requirements. Proof of residency and age may be required. All directors and officers of Sponsor, and the immediate family of such individuals, are not eligible to enter. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, and spouses. Raffle void wherever prohibited by law.

 

PRIZE

One (1) winner will receive half of the net proceeds obtained during the Raffle Period (less any applicable taxes or withholding amounts required or permitted by law). The remaining half will be retained by Sponsor. No transfer, refund, substitution, or replacement of prize permitted by winner. Winner is solely responsible for the reporting and payment of all applicable federal, state, and local taxes (associated with the receipt of any prize). Any portion of the prize not accepted or unclaimed by the winner will be forfeited and will not be substituted.

 

RANDOM DRAWING; ODDS

One (1) winner will be chosen at random from all eligible tickets purchased during the Raffle Period. The drawing will take place at approximately 5:00 PM (EST) on June 25, 2020 at the Crystal Springs Golf Resort, 1 Wild Turkey Way, Hamburg, NJ 07419. Sponsor will conduct the drawing. The decision shall be final and binding. Odds of winning depend on the total number of tickets purchased during the Raffle Period.

 

ANNOUNCEMENT OF WINNER; CLAIMING THE PRIZE

The winner will be announced at approximately 5:00 PM (EST) following the random drawing. Winner need not be present to win. If the winner is not present, he or she will be notified by email and/or phone and will have thirty (30) days to respond and claim the prize. If the winner fails to respond within thirty (30) days, the prize will be forfeited without prior notice. If the prize is forfeited, unclaimed, or declined, no alternate shall be chosen, no prize shall be awarded, and all proceeds shall be retained by Sponsor. All decisions of Sponsor shall be final and will not be reviewed. Winner may be subject to verification of eligibility, in Sponsor’s sole discretion. Winner may be required to execute a liability release and any applicable forms and documents relating to tax compliance in connection with receipt of the prize. Prize will be delivered via check and mailed to the winner. The winner’s information will also be announced on Sponsor’s website and social media page(s) on or about June 30, 2020.

 

PUBLICITY RELEASE

Except where prohibited by law, by accepting a prize, the winner agrees and acknowledges that Sponsor and any of its designees may, without any limitation or further compensation, use winner’s full name, city and state of residence, photograph or other likeness, biographical information, and/or statements made by winner regarding the Raffle or Sponsor, worldwide and in perpetuity for any and all lawful purposes.

 

RELEASE OF LIABILITY; DISCLAIMER OF WARRANTY

By participating in the Raffle, all Entrants agree to release and hold harmless Sponsor, its affiliated entities, and their respective directors, officers, employees, agents partners, representatives, agents, successors and assigns, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, which may occur, in whole or in part, directly or indirectly, in connection with preparation for, or participation in, the Raffle, or possession, acceptance and/or use or misuse of the prize or participation in any Raffle- related or prize-related activity and for any claims or causes of action based on publicity rights, defamation, or invasion of privacy.

 

APPLICABLE LAW; VENUE

These Official Rules, their interpretation, and any disputes arising from them, shall be governed by the laws of the State of New Jersey without giving effect to any conflict of law provisions. Each Entrant agrees to submit to the nonexclusive personal jurisdiction of the courts located within the State of New Jersey, which shall be the exclusive venue for the adjudication of any disputes arising in connection with this Raffle.

 

ADDITIONAL TERMS AND CONDITIONS

Sponsor reserves the right in its sole discretion to disqualify any entry that it believes violates or potentially violates any provision of these Official Rules.

•   If required to do so by law, changes in circumstances, or considerations beyond the reasonable control of the Sponsor, Sponsor reserves the right to terminate the Raffle early or cancel the Raffle.

•   Provisions dealing with warranties, indemnification, eligibility for and forfeiture of prize, and taxes shall survive in perpetuity.

•   If for any reason, this Raffle is not capable of running as planned due to causes beyond Sponsor’s control, Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Raffle. Sponsor also reserves the right to disqualify any individual who tampers with the entry process. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES AT LAW OR IN EQUITY FROM ANY SUCH PERSON(S) RESPONSIBLE TO THE FULLEST EXTENT PERMITTED BY LAW.

•   ENTRANTS EXPRESSLY UNDERSTAND AND AGREE THAT THEIR PARTICIPATION IN THE RAFFLE IS STRICTLY VOLUNTARY AND AT THEIR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONSOR EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE RAFFLE INCLUDING BUT NOT LIMITED TO ANY PRIZE, WHICH SHALL BE AWARDED ON AN “AS IS” BASIS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY AN ENTRANT FROM EITHER SPONSOR OR ANY THIRD PARTY SHALL CREATE ANY WARRANTY.

•   IN NO EVENT SHALL SPONSOR, ITS AFFILIATES, OR THEIR RESPECTIVE TRUSTEES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE TO ENTRANTS FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF PARTICIPATION IN THIS RAFFLE WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SPONSOR OR A RELATED PARTY HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
